Fish and Wildlife Service which intends to use the same land in Anderson and Cherokee counties for a huge nature preserve. WHAT DALLAS SAYS: In their petition to the court city attorneys wrote that the city and the water board have a "duty to satisfy the water supply needs of the millions of current and future residents of North Texas. " Fish and Wildlife dismissed the city’s "extensive water management [plan] as ’speculation’. without even a look at the effect upon future water supplies" the petition states.

New Legislation Aims To Close ‘Halliburton Loophole’

As so-called unconventional gas drilling expands across the country the potential threats to water from this unregulated practice continue to grow. In response local governments and water districts have passed resolutions that demand action to close the loophole and protect drinking water. The Township of Nockamixon Pennsylvania has recently taken steps to protect water and other community resources in the face of drilling. The Township amended local drilling regulations in 2006 and earlier this month they adopted a resolution calling for supporting Congressional action to require fracturing to comply with the Safe Drinking Water Act. “Current regulation of hydraulic fracturing is not sufficient” said Supervisor Chair Nancy Janyszeski of Nockamixon. “From where I sit ensuring a federal minimum water standard and disclosing chemical makeup is essential. ” In 2008 the Delaware River Basin Commission (DRBC) adopted Special Protection Waters (SPW) this month they announced they will require anybody drilling for gas within the area to apply for a drilling permit.

  Because farmers receive their water from the urban supply they were riding the same price elevator. In an effort to mitigate the damage to farmers from rising prices the Metropolitan Water District (MWD) of Southern California adopted the Interim Agricultural Water Program (IAWP) in 1994. The San Diego County Water Authority (CWA) also established its own Special Agricultural Water Rate (SAWR) in 1998.   Both programs relied on the premise that water for farmers would be considered ?surplus? and farmers would pay less for water in exchange for a lower level of service.

It’s called the Southern Delivery System. Pueblo West which will get some water from SDS must also return a billion gallons of water a year to the Arkansas River in Pueblo. Pueblo West says that would drain its water supply. Also water taps issued for new homes could be cut off. "We may have to take a serious look at issuing any more water taps. So in other words that would limit our growth and hurt our community severely" said Harrison. Although Pueblo County has described the impact to Pueblo West as "minimal" Pueblo West is suing the county.

Frank Mautino (D-Spring Valley) and State Sens. Susan Garrett (D-Lake Forest) and Emil Jones III (D-Chicago) sponsored House Bill 4021. The legislation was developed in response to recent revelations that the Village of Crestwood had been supplementing the town’s water supply with water from a well found to be contaminated more than 20 years ago. While current law requires notification of contamination to the owners and operators of the water system (in this case the Village of Crestwood) it does not currently mandate notification to the people who drink the water. House Bill 4021 corrects that problem by requiring prompt notice to all of the users of the water when contamination is discovered. The bill also makes providing false information to environmental enforcement officials a felony under state law. “We need to make sure that what happened to Crestwood residents never happens again in Illinois” said Madigan.
